Confidentiality



All transactions involving Exxcomm and Independent Representatives are protected by the "Confidentiality Ordinance" which makes it a criminal offence to disclose information.

These Confidentiality Laws essentially state that any person in a position of trust (ie; banks, trust companies and attorneys etc.), shall not disclose any information to any person or government without first obtaining the clients' consent. Should the client withhold consent, the entity standing in a position of trust is under no obligation to disclose information, unless required to do so by virtue of a court order rendered only by the Turks and Caicos Islands Government.

Foreign court judgements will not generally be enforced and court orders requiring disclosure are rare. Unless criminal activity can be shown, any violation of privacy would compromise the integrity of the tax haven resulting in a harm to the Centre.
