The Turks and Caicos Islands are a true tax haven. There is no Income, Capital Gains, Value Added or Inheritance Taxes. Income earned in the Turks and Caicos Islands is not, therefore taxable by the Turks and Caicos Islands Government.
Whether the income earned is taxable in the applicants home jurisdiction will depend upon the laws of that country. If the jurisdiction only taxes income earned within the Home Jurisdiction, then the Exxcomm commissions are clearly not taxable. Other jurisdictions which tax income earned worldwide normally have a number of exceptions to the taxation of income earnt outside that country.
These exceptions vary from country to country. Common exceptions are active income earned Off-shore (as opposed to investments) and income which is not repatriated.
All transactions involving Exxcomm and Individual Independent Representatives are protected by the "Confidentiality Ordinance" which makes it a criminal offense to disclose information.
These Confidentiality laws essentially state that any person in a position of trust ie; banks, trust companies and attorneys etc. shall not disclose any information to any person or government without first obtaining the client's consent. Should the client withhold consent, the entity standing in a position of trust is under no obligation to disclose information unless required to do so by virtue of a court order rendered by the Turks and Caicos Islands Government. Foreign court judgements will not be enforced and court orders requireing disclosure are rare. Unless criminal activity can be shown, any violation of privacy would compromise the integrity of the tax haven resulting in a harm to the Centre.
